PROYECTO DE LEY

Artículo único. – Los afiliados al Banco de Previsión Social (BPS) (activos, pasivos y empresarios) que estando obligados a sufragar el domingo 28 de noviembre de 2021, según lo dispuesto por la Ley Nº 16.241, de 9 de enero de 1992, no lo hubiesen hecho, no serán pasibles de las sanciones previstas en el artículo 21 de la Ley Nº 16.241.

La no aplicación del artículo 21 de la Ley Nº 16.241 regirá para todos los casos de habilitados para votar que no lo hayan hecho y solo para el caso concreto de la elección realizada el 28 de noviembre de 2021.

VISTO: la Resolución Nº 798/2012 de 8 de mayo de 2012.

RESULTANDO: que la norma referida estableció las condiciones que regulan el régimen de documentación mediante comprobantes fiscales electrónicos.

CONSIDERANDO: necesario efectuar algunas adecuaciones al mismo.

ATENTO: a lo expuesto;

LA DIRECTORA GENERAL DE RENTAS

RESUELVE:

1.- Sustitúyese el segundo inciso del literal a) del numeral 1º) de la Resolución Nº 798/2012 de 8 de mayo de 2012, por el siguiente:

“No obstante, en las operaciones propias de actividades económicas que deban preceptivamente documentarse a consumo final de acuerdo a la normativa vigente, se utilizarán e-Tickets.”

2.- Sustitúyese el literal b) del primer inciso del numeral 20º) de la Resolución Nº 798/2012 de 8 de mayo de 2012, por el siguiente:

“b) en el caso de operaciones documentadas en e-Tickets y sus notas de corrección, se deberá enviar cada uno de los referidos CFE, previo al envío al receptor electrónico; al transporte de mercaderías o a la entrega de la representación impresa al consumidor final; según corresponda, en los siguientes casos:

– cuando el monto neto supere las UI 10.000 (diez mil unidades indexadas) excluido el IVA, según cotización vigente al cierre del año civil anterior,

– sin importar su monto, cuando:

* los mismos documenten retenciones o percepciones;

* correspondan a actividades económicas que deban preceptivamente documentarse a consumo final de acuerdo a la normativa vigente y el receptor se identifique con número de RUC;

* se documenten:

* exportaciones de servicios

* operaciones comprendidas en el Decreto Nº 378/2012 de 23 de noviembre de 2012.

3.- Sustitúyese el sexto inciso del numeral 20º) de la Resolución Nº 798/2012 de 8 de mayo de 2012, por el siguiente:

“Adicionalmente, todo emisor electrónico deberá generar automáticamente y enviar a la Dirección General Impositiva, un reporte diario consolidado incluyendo un detalle de los CFE y los CFC emitidos en el día, discriminados por tipo y fecha del comprobante, sucursal y si corresponden operaciones comprendidas en la Resolución Nº 10197/2018 de 1 de noviembre de 2018, así como la numeración insumida por los comprobantes emitidos y anulados.”

4.- Sustitúyese el literal a) del segundo inciso del numeral 23ºbis) de la Resolución Nº 798/2012 de 12 de mayo de 2012, por el siguiente:

“a) cuando se trate de cobranzas de operaciones propias o adelantos de precio: documentarlas de manera independiente del resto de las operaciones del sujeto pasivo, en el CFE que corresponda, identificando que se trata de una cobranza y considerando el referido importe como monto no facturable. En la representación impresa deberá consignarse, a continuación del tipo de comprobante, la leyenda “Cobranza” en caracteres no inferiores a 3mm de alto.”

5.- Lo dispuesto en la presente resolución regirá para comprobantes fiscales electrónicos emitidos a partir del 1º de febrero de 2022.

6.- Publíquese en el Diario Oficial. Insértese en la página web. Cumplido, archívese.

ACTA DE CONSEJO DE SALARIOS. En Montevideo, el 22 de noviembre de 2021, reunido el Consejo de Salarios del Grupo Nº 21 “Servicio Doméstico”, integrado: por el Poder Ejecutivo: Lic. Marcelo Terevinto, Soc. Andrea Badolati y Dra. Jimena Ruy-López; por el Sector Empleador: Sra. Mabel Lorenzo de Sánchez, y por el Sector Trabajador: Sras. Lucía Gándara y Betty Cabrera, asesoradas por Ec. Alejandra Picco, SE ACUERDA lo siguiente:

PRIMERO: Vigencia y oportunidad de los ajustes salariales:

El presente Acuerdo de Consejo de Salarios abarcará el período comprendido entre el 1º de julio de 2021 y el 30 de junio de 2023, aplicándose ajustes salariales en las siguientes oportunidades: 1º de julio de 2021, 1º de enero de 2022, 1º de julio 2022, 1º de enero 2023.

SEGUNDO: Ajustes salariales de cada período

I) 1º de julio de 2021: Se otorgará un porcentaje de aumento salarial total de 4,04% resultante de la acumulación de los siguientes factores:

a) Por concepto de inflación proyectada en los Lineamientos del Poder Ejecutivo para el período 1º de julio 2021- 31 de diciembre 2021 (1,8%);

b) Por concepto de adelanto de inflación proyectada (2,2%).

Este porcentaje (4,04%) se abonará sobre los salarios vigentes al 30/6/2021 una vez aplicado el correctivo final de inflación del Acuerdo anterior que, según Acta de 14/7/2021, fue del 0,69%.

La retroactividad generada por el aumento al 1/7/2021 debe abonarse en una sola vez conjuntamente con el primer salario que se pague a partir de la entrada en vigencia del presente acuerdo, salvo los acuerdos particulares que puedan realizarse entre cada empleador y trabajador respecto a la forma de pago.

Se descontarán aquellos aumentos que pudieron haberse otorgado a cuenta del ajuste de julio 2021.

II) 1º de enero 2022: Todo trabajador del sector percibirá a partir del 1º de enero de 2022 sobre sueldos vigentes al 31 de diciembre de 2021 un ajuste de 1,47 %, compuesto por: 3,7 % por concepto de inflación proyectada en los Lineamientos del Poder Ejecutivo, al que se le resta el 2,2% adelantado en julio 2021 (1,037/1,022)

III) 1º de julio 2022: Se otorgará un porcentaje de aumento salarial total de 2% por concepto de inflación proyectada en los Lineamientos del Poder Ejecutivo para el período 1º de julio 2022 – 31 de diciembre 2022.

Dicho porcentaje podrá verse afectado por la aplicación del correctivo por IPC descripto en la cláusula tercera, numeral 1.

III) 1º de enero 2023: Se otorgará un porcentaje de aumento salarial total de 3% por concepto de inflación proyectada en los Lineamientos del Poder Ejecutivo para el período 1º de enero 2023 – 30 de junio 2023

TERCERO: Correctivos por IPC

1) A los 12 meses de vigencia del presente Acuerdo se aplicará, si corresponde, un ajuste salarial adicional en más, por la diferencia entre la inflación observada durante dicho período y los ajustes por inflación proyectada otorgados en el mismo año (1/7/21 – 30/6/22), de forma de asegurar que no haya pérdida del salario real.

2) Al final del Acuerdo se aplicará si corresponde, un ajuste salarial adicional en más por la diferencia entre la inflación observada durante el segundo año de vigencia del acuerdo y los ajustes por inflación proyectada otorgados en el mismo (1/7/22 – 30/6/23), de forma de asegurar que no haya pérdida de salario real.

El Consejo de Salarios se reunirá oportunamente a los efectos de dejar constancia de los porcentajes de dichos correctivos y de los salarios mínimos correspondientes.

CUARTO: SALARIOS MÍNIMOS

l. SALARIO MÍNIMO 1/7/21 – 31/12/21

Una vez aplicados los ajustes referidos en la cláusula segunda I del presente Acuerdo, el salario mínimo del sector será de $23.144 por 44 hs. semanales de labor y 25 jornales. El valor hora ascenderá a $121,76.

II. SALARIOS MÍNIMOS 1/1/22 – 30/6/22

Una vez aplicados los ajustes referidos en la cláusula segunda II del presente Acuerdo, el salario mínimo del sector será de $23.484 por 44 hs semanales de labor y 25 jornales. El valor hora ascenderá a $123,55.

QUINTO: Enfermedad:

Los trabajadores que, siguiendo las formalidades y procedimientos vigentes exigidas para percibir el subsidio por enfermedad, sean certificados por enfermedad común por un período de 7 (siete) días, o más, percibirán de su empleador el pago del 100% del valor de su jornal durante los tres primeros días, salvo en aquellas situaciones referidas en el inciso 2 del artículo 14 del Decreto-Ley Nº 14.407 (hospitalización).

SEXTO: Cláusula de paz: Durante la vigencia del presente Acuerdo, el SUTD no realizará petitorios de mejoras salariales, ni promoverá acciones gremiales de clase alguna que tengan relación directa o indirecta con todos los aspectos acordados en el presente acuerdo, con excepción de aquellas medidas que con carácter general resuelva el PIT-CNT.

SÉPTIMO: Beneficios: Las partes declaran, que de acuerdo con los dispuesto en el artículo 17 de la Ley Nº 18.566, las cláusulas contenidas en el presente Acuerdo del Consejo de Salarios, así como en los anteriores, mantendrán su vigencia hasta tanto sean sustituidas por otra decisión de Consejo de Salarios en acuerdo de los actores sociales o Convenio Colectivo entre las organizaciones más representativas, con excepción de las cláusulas que refieren a los ajustes salariales. Se lee la presente y se ratifica su contenido, para constancia de lo cual se firma en 6 ejemplares de un mismo tenor en el lugar y fecha arriba indicados.
